Pacha Mama Spirit — Terms and Conditions

This site is administered by Pacha Mama Spirit, Travel Agency and Tour Operator, authorized by the Ministry of Culture of Cusco, the regulatory body for the Inca Trail.

General Terms:

  • This document constitutes a legally binding contract.
  • By purchasing our services, the client accepts these terms and conditions.
  • No agent outside of Pacha Mama Spirit has the authority to modify, limit, or extend the terms of this contract.

Limitation of Liability:

  • Pacha Mama Spirit accepts responsibility only for acts carried out by our own staff.
  • Pacha Mama Spirit is not responsible for any action or event that is unavoidable or unforeseeable, nor for misconduct caused by clients or third parties.
  • Pacha Mama Spirit is not responsible for bad weather, unavoidable accidents, property damage, loss of personal belongings, natural disasters, additional costs due to last-minute events, strikes, etc. It is each client's responsibility to hold adequate travel insurance to cover any such events.

Cancellations and Changes by the Company:

Pacha Mama Spirit reserves the right to cancel any trip in the following cases:

  • If the client has not completed 100% of the total tour price at least 2 weeks (15 days) before the tour departure date, the agency may make changes to the contracted service.

Modifications Made by Clients:

Any modification is subject to availability. Modifications are subject to the following penalty schedule:

INCA TRAIL
  • Once a booking has been made and payment — whether full or partial — has been received, no modifications to passenger information or travel dates are possible. This is in accordance with regulations set by the Ministry of Culture.
SALKANTAY / LARES / HUCHUY QOSQO / AUSANGATE AND OTHERS
  • Modifications made more than 30 calendar days before the service date are subject to a 20% penalty charge.
  • Modifications made between 29 and 8 calendar days before the start date carry a 50% penalty on the total service payment.
  • No modifications are accepted within 7 or fewer days before the start date. The total amount paid will be forfeited.

Cancellations Made by Clients:

  • Cancellations or changes by the client must be submitted in writing as soon as possible.
  • The client is responsible for any costs or expenses incurred due to the cancellation.
  • All applicable refunds will be issued directly to the client's credit card or bank account.
  • Cancellation penalties:
    • Cancellation after permits have been registered and purchased results in the loss of the full deposit. Booking deposits are non-refundable.

Flight Cancellations:

  • All flight cancellations are subject to the cancellation conditions imposed by the airlines.
  • We act as your agent and bear no responsibility for the actions of airline carriers, including accidents, death, personal injury, property damage, or flight delays.

Pricing:

  • All prices listed are per person and expressed in US dollars.
  • Once a 60% deposit of the tour cost is received, your travel package booking is confirmed.
  • Prices shown on this website do not include any additional transfer or sending fees.
  • Please enquire about any applicable transfer fees before making a deposit or wire transfer, to avoid last-minute inconveniences.

Bookings:

To make a booking you must provide certain information. This information must be accurate and complete, EXACTLY AS IT APPEARS ON YOUR IDENTITY DOCUMENT OR PASSPORT, which you must carry throughout your tour or trek. Please note that this information will be handled confidentially.
To make a booking, please send us an email with the following details:

  • Type of service
  • Start date
  • Number of passengers
  • Full name (as it appears on your passport)
  • Passport number
  • Nationality
  • Age
  • Any important information we should know

Please carry original documents during your trip; otherwise the entry checkpoint will void your permit.
For minors, a copy of a valid identity document and/or passport is mandatory. We recommend treks for children aged 7 and above.
Documents must be valid for at least 5 days beyond the tour start date. Control points are located at the start of the trek and at the entrance to the Machu Picchu Citadel.
For Peru residents of any nationality, please send a copy of your CE card (Foreigner ID Card).
If you obtain a new passport after making your booking (at which point permits will already have been purchased), you must carry both your old and new passport; otherwise the checkpoint will deny you entry.
